On, April 19, 2024, the U.S. Department of Education issued updated final regulations enforcing Title IX (“the 2024 Title IX Regulations”).
On, July 23, 2024, The City University of New York Board of Trustees adopted the Policy on Sex-Based Misconduct (“the Policy”). This Policy replaced the Policy on Sexual Misconduct.

The Policy discusses Mandatory Reporters – formerly called “Responsible Employees” – in Section VI(B).
Mandatory Reporters are employees (other than Confidential Employees – see Section V(A)) who:
- Has the authority to institute corrective measures on behalf of CUNY; or
- Has responsibility for administrative leadership, teaching, or advising within CUNY.
Mandatory Reporters must notify the Title IX Coordinator for their school, college, or unit when they reasonably suspect or observe conduct that may constitute Sex-Based Misconduct under the Policy.

If an employee is informed by a student that the student is pregnant, the employee must:
- Provide the student with the contact information for the Title IX Coordinator at the student’s school, college, or unit; and
- Inform the student that the Title IX Coordinator can coordinate specific actions to prevent Sex-Based Misconduct and ensure the student’s equal access to CUNY’s education programs or activities.
